BOISE, Idaho - Idaho's wrongful death statute provides for a separate cause of action for which the two-year statute of limitations begins running at the decedent's death, the Idaho Supreme Court held Aug. 18 (Mildred Castorena, et al. v. General Electric, et al.; Willis Eugene Norton Sr., et al. v. General Electric, et al. John D. Adamson, et al. v. FMC Corp., et al., Nos. 35123, 35124, 35852, Idaho Sup.; 2010 Ida. LEXIS 158).

JACKSON, Miss. - A judge acted within his discretion in concluding that a railroad and asbestos plaintiffs reached a settlement of asbestos claims and not simply a method for resolving the cases on a case-by-case basis, a divided Mississippi Supreme Court held Aug. 26 (Illinois Central Railroad Co. v. Gary R. Byrd, et al., No. 2009-CA-0065-SCT, Miss. Sup.; 2010 Miss. LEXIS 444).
